Event and Prize Draw Conditions

BEFORE ENTERING THE ABOVE EVENT AND PRIZE DRAW, YOU MUST READ AND ACCEPT THESE EVENT AND PRIZE DRAW TERMS AND CONDITIONS. BY PARTICIPATING IN THE UNDER ARMOUR EVENT, YOU ACCEPT THAT YOU ARE BOUND BY THE EVENT AND PRIZE DRAW TERMS AND CONDITIONS.

Event and Prize Draw Terms and Conditions: By participating in the Event and Prize Draw, these Event and Prize Draw Terms and Conditions shall be deemed to be a legally binding agreement between you and the Promoter (as defined below). In particular, by entering the Event and Prize Draw, you agree that the Promoter may use the personal information you provide for activities related to the Event and Prize Draw (including promotional purposes for future Prize Draws, should you be the winner). Participation in the Event and Prize Draw is free of charge and governed solely by these Event and Prize Draw Terms and Conditions.

Promoter: The Promoter of the Prize Draw is Designer Outlet Neumünster (Neumünster Designer Outlet GmbH, Oderstraße 10, 24539 Neumünster; imprint: https://www.mcarthurglen.com/outlets/de/de/designer-outlet-neumuenster/kontakt/).

Dates of the Event and Prize Draw: The date for the Event and Prize Draw is Friday, 24 September 2021, from 10 am to 6 pm. The prize for the Prize Draw (a total of two pairs of "Under Armour" sports shoes) and the goodies for participating in the Event will be handed over exclusively at the event location, the Brunnenplatz/water fountain in the Promoter’s buildings (next to the "adidas" and "Lindt" stores). Two training sessions will be held there on 24 September 2021, one at 11 am and one at 5 pm, each of which will be a sports activity event held outdoors and each of which will give up to forty participants the opportunity to perform an approximately 20-minute full-body workout under the instruction of trainers from Meridian Spa Kiel with professional guidance; no sports equipment or physical contact will be involved.

Eligibility: Participants in the Event and Prize Draw must be a natural person of legal age, have subscribed to the Promoter's "Under Armour Event" Event and Prize Draw newsletter and have received the Promoter's special Event and Prize Draw newsletter to their own email address (under which they have subscribed to the Promoter's "Under Armour Event" newsletter) no later than midnight on 23 September 2021. Sweepstakes clubs and automated sweepstakes services are not eligible. The following are also not eligible:

(a) employees or immediate family members of any employee of the Promoter or its promotional partners, their associated companies, agents, affiliates or subsidiaries, and any person otherwise connected with the administration of the Event and Prize Draw.

(b) persons who have already won an (other) event and Prize Draw organised by the Promoter in the past 24 months.

In addition, the Promoter reserves the right, at its sole discretion, to exclude persons from participation if there are justified reasons, for example (i) in the event of manipulation in connection with access to or the implementation of the Event and Prize Draw, (ii) in the event of breaches of these Terms and Conditions, (iii) in the event of unfair conduct or (iv) in the event of false or misleading information in connection with participation in the Event and Prize Draw.

Age of majority: By participating in the event and Prize Draw, you confirm that you are 18 years or older.

Participation: Participation is free of charge and takes place after registration on the homepage (https://www.mcarthurglen.com/outlets/de/de/designer-outlet-neumuenster) exclusively via receiving the special Event and Prize Draw newsletter "Under Armour Event" of the Promoter. Because the two training sessions are each limited to a maximum of 40 participants, a maximum of 80 people in total can take part in the Event and Prize Draw; in this respect, the priority principle applies, the first 80 participants who register for the Event and Prize Draw on the Promoter’s homepage and have been sent the corresponding newsletter and who appear at the event venue on 24 September 2021 are entitled to take part on 24 September 2021.

Prize/Goodies: The prize for the Prize Draw on 14 September 2021 consists of a total of two pairs of "Under Armour" sports shoes, with one pair each to be raffled among the participants of the total of two training sessions. In addition, goodies will be distributed to all participants of the total of two training sessions. These goodies will be one "Under Armour" sports bag per participant, which will contain various items (water, fruit, shopping vouchers, etc.).

Chances of winning: The chances of winning the prizes depend on the number of participants per training session. The goodies will be given to each eligible participant of the two training sessions.

Determination of the winners:

(a) Determination of the prize - Every subscriber to the "Under Armour Event" Event and prize Prize Draw newsletter who receives the special Event and Prize Draw newsletter after registering can report to the event venue on 24 September 2021 by presenting their identity card/passport and showing the "Under Armour Event" Event and Prize Draw newsletter received and addressed to them. At the event venue, in addition to the "Under Armour Declaration of Liability and Risk", the "Under Armour Event Hygiene Concept" must also be signed in order to participate in the Event and Prize Draw; in addition, proof of one's own recovery, vaccination or negative testing with regard to the Covid 19 virus must be presented, whereby in the case of negative testing, a negative PCR test is required, which must be dated 24 September 2021. The winning of the prizes will be determined and awarded strictly at random, one participant from each of the two training sessions will be selected automatically by random draw. The Promoter will determine in its sole discretion whether participation is in full compliance with these Event and Prize Draw Terms and Conditions. Each participant may participate in a maximum of one of the two training sessions.

(b) Notification of Winners - Each of the winners of the prizes determined in the manner described above will be notified immediately at the event venue on 24 September 2021 after the completion of the respective training session; the prizes will be distributed immediately to the two winners. The goodies will be distributed immediately to all participants after both training sessions.

(c) Acceptance of the prize - Each winner must immediately confirm acceptance of the prize by receiving the prize. The prize cannot be paid out in cash or received by post.

(d) Identification - Each winner must present valid proof of identity (identity card or passport) at the time of prize acceptance.

(e) Promotional purposes - Each participant in the Event and Prize Draw agrees to and consents to the collection, preparation and processing of his/her personal data, images and videos by the Promoter for the purpose of publication on the Promoter’s website and/or for the purpose of marketing, disclosure of names and residences of participants to third parties in connection with the Event and Prize Draw, without receiving any consideration in return; in particular, the Promoter is not obliged to pay any royalties or provide any other consideration. Personal data includes the name, address and date of birth of the participants. Each participant is aware that the data, image and sound recordings are personal data within the meaning of Article 4 number 1 DSGVO and that the use and processing of the data, image and sound recordings by the Promoter are not dependent on any further prior information or additional release in individual cases. Each participant is aware that, in particular, the image and sound recordings can be accessed worldwide when published on the Internet and, if applicable, can be found by search engines, that further use and/or modification by third parties cannot be ruled out and that, under certain circumstances, complete deletion on the Internet is not possible. Each participant may informally revoke his/her consent to the Promoter at any time without stating reasons; the revocation of consent does not retroactively eliminate the lawfulness of the data processing which took place on the basis of the consent given up to the revocation by the Promoter. The processing of the image and sound recordings by the Promoter shall remain lawful until the time of revocation.

Taxes: The Promoter is responsible for reporting and paying all taxes, fees and other charges, insurance premiums and handling charges and any other costs incurred in order to redeem a prize.

Disclaimer: The Promoter makes no warranties or representations of any kind with respect to the Event and Prize Draw, any prize, the goodies or with respect to (the ability of) any (potential) participant to participate in the Event and Prize Draw, except as expressly set out in these Event and Prize Draw Terms and Conditions. The Promoter excludes all liability for participation in the Event and Prize Draw and is therefore not liable for any damage or other disadvantages resulting from participation in the Event and Prize Draw or from winning or using a prize/goodie. This does not apply to damages to life, body and health or to damages resulting from intentional or grossly negligent injuries of the Promoter, its prize sponsors or its dealers as well as its or their legal representatives or vicarious agents, nor to any liability under the Product Liability Act.

Waiver of any legal rights: By participating in the Event and Sweepstakes, you agree to indemnify and hold harmless the Promoter, its prize sponsors, McArthurGlen Designer Outlets retailers and their respective affiliates and employees from and against any and all claims of any nature whatsoever by you, arising directly or indirectly from (a) participation in the Event and Prize Draw (b) receipt, use or misuse of the prize/goodies (c) typographical, clerical or other errors in all materials and notices involved, made or given in connection with the Event and Prize Draw (d) other errors in the Event and Prize Draw. This does not apply to damage to life, limb or health or to damage caused by intentional or grossly negligent injuries of the Promoter, its prize sponsors or its dealers or its legal representatives or vicarious agents or to liability under the Product Liability Act.

Trademarks: All trademarks, copyrights and other images displayed are the property of the Promoter or its licensors and are used under written or implied licence. The use of any third party materials (including such trademarks) does not imply any business relationship between such third parties and the Promoter or vice versa.

Changes: The Promoter reserves the right, at its sole discretion and without prior notice, to suspend, postpone or cancel the Event and Prize Draw or to amend the Event and Prize Draw Terms and Conditions at its sole discretion in the following situations: (a) in the event of an accident (b) if a typographical, administrative or other error has occurred (c) if necessary for the proper and safe conduct of the Event and Prize Draw (d) if at any time there is evidence of tampering or other unforeseen events that may affect the proper conduct of the Event and Prize Draw (e) if current events surrounding the Covid 19 pandemic at the Venue so require. General Provisions: Failure to comply with these Event and Prize Draw Terms and Conditions may (at the sole discretion of the Promoter) result in disqualification from the Event and Prize Draw. This Event and Prize Draw and these Event and Prize Draw Terms and Conditions are governed by German law. The Promoter is under no obligation to disclose any information relating to the Event and Prize Draw, including the number of entry forms received, the number of valid entry forms or any other figures relating to the Event and Prize Draw, except as required by law or as expressly set out in the Event and Prize Draw Terms and Conditions. The Promoter shall not be liable to anyone (including participants) for any delay or failure in the performance of the Event and Prize Draw caused by circumstances beyond the Promoter's control, including (without limitation) internet performance problems, loss or misdelivery of information (including in entry forms), breakdowns or acts of God. The Promoter reserves the right to exclude any individual participant from the Event and Prize Draw if there is reason to believe that the Event and Prize Draw Terms and Conditions have been breached or the Event and Prize Draw has been tampered with by that participant. Disputes relating to the Event and Prize Draw will be decided at the sole discretion of the Promoter, which decision will be final and binding. The right to take legal action is excluded.

Should any provision of these event and Prize Draw conditions be or become void, invalid or unenforceable in whole or in part, this shall not affect the validity of the remaining provisions of these Event and Prize Draw Terms and Conditions. Instead of the void, invalid or unenforceable provision, the legally permissible provision that comes closest in economic terms to the meaning and purpose expressed in the void, invalid or unenforceable provision shall apply. The same applies in the event of a loophole in these Event and Prize Draw Terms and Conditions.

Personal Data: By participating in the Event and Prize Draw, each participant consents to the processing of their personal data solely in relation to the Event and Prize Draw in accordance with the Promoter's privacy policy. For further information on the processing of personal data and your rights, please refer to the Promoter's privacy policy on its website: https://www.mcarthurglen.com/en/privacy-and-cookies-policy/.

Participation in the Event and Prize Draw requires the provision of personal data. The participant assures that the personal data provided by him/her, in particular first name, surname and email address, are true and correct. The processing of the personal data collected in the context of the Event and Prize Draw is carried out for the implementation and handling of the Event and Prize Draw on the basis of Article 6 para. 1 sentence 1 lit. b GDPR.

The Promoter points out that all personal data of the participant will neither be passed on to third parties nor made available to them for use without consent.

For the purpose of the proper implementation of the Event and Prize Draw, including enabling the legally/officially required traceability of the participants for reasons of health protection (of e.g. Covid-19-related chains of infection) by the competent health authorities, the Promoter collects corresponding personal data. The Promoter's data protection declaration (https://www.mcarthurglen.com/en/privacy-and-cookies-policy/) also applies to the handling of this data.
