Article 1. Organising company
The McArthurGlen brand Village "Paris-Giverny", located at ZAC Normandie Parc – 1 avenue
du 13ème Dragons in Douains (27120) – France (hereinafter referred to as "the Centre"), owned
by MGE Normandie, a general partnership with capital of €2,357,026.70, registered with the
Paris Trade and Companies Register under number 531 948 461, and whose registered office
is located at 8 avenue Hoche in Paris (75008) France, is organising a game entitled "Win a car",
which will commence in the Centre on 8th August 2024 at 10:00 AM and which will end on 30
September 2024 at 8:00 PM (hereinafter referred to as the "Closing Date"). The draw of the
Winner (hereinafter the “Winner”) will take place within 48 hours of the Closing Date
(hereinafter referred to as the “Game”).
MGE Normandie appoints McArthurGlen UK Limited, registered under number 02810264,
Nations House, 3rd Floor, 103 Wigmore Street, London, W1U 1WH, United Kingdom, to assist
it in the organisation, running and animation of the Game (hereinafter referred to as “the
Organiser”).
Participation in the Game implies full and complete acceptance of these rules (hereinafter the
“Rules”).
Article 2. Prize
The Organiser is offering a white, 3-door, 1.0 - 4 fiscal HP - 70 bhp, eco hybrid passenger new
car, worth €14,800.00 including tax (Fourteen thousand eight hundred euros including tax), to
be won (hereinafter the "Prize").
The car that is the subject of the Game will be displayed throughout the duration of the Game
in the Centre.
The stated value of the Prize corresponds to the purchase price of the Prize by the Organiser.
The Prize is non-modifiable, non-exchangeable, non-transferable and non-refundable. The
Prize may not be the subject of a request for financial compensation, exchange or recovery,
for any reason whatsoever. The Winner may not request additional services not included in
the description of the Prize.
The Organiser reserves the right, if circumstances so require, to substitute the Prize, at any
time and at its sole discretion, with a prize of equivalent commercial value and with equivalent
characteristics.
If the Winner does not accept the substitution, he/she will lose his/her right to the Prize
without any recourse against the Organiser.
Article 3. Access and conditions of participation
The Game is reserved for any individual who is 18 years of age or older on the date of
participation in the Game. The Participant must be a validly registered member of the
McArthurGlen Club, the terms and conditions of which are accessible by clicking on the
“Your” or “Yours”).
By accepting the Regulations, You confirm that you are 18 years of age or older, that You are
not subject to any sanctions by France, the United Kingdom, the European Union, USA or
Canada and that Your residence is not located in a country subject to restrictive sanctions by
France, the United Kingdom, the European Union, USA or Canada.
Please note that to play the Game, You must have a mobile phone with an Internet browser.
Any related costs will be borne exclusively by the Participant.
To participate in the Game, You must:
- Make one or more purchases of products and/or services in the Centre, for a minimum
total amount of €150 including VAT (without exchange and without reimbursement),
on the same day, during the duration of the Game and before the Closing Date
(hereinafter "Conditions of Purchase");
- Go to the Centre's reception desk (Reception - Guest Services) and present the hard
copy receipts proving that you comply with the Conditions of Purchase;
- Confirm at the Centre reception that You are a member of the McArthurGlen Club or
join the McArthurGlen Club directly;
- Scan the QR code that will be presented to You by the Centre's reception desk each
time You fulfil the Conditions of Purchase;
- Enter the email address used in connection with Your registration with the
McArthurGlen Club;
- Enter the entry code which will be provided by Centre's reception desk; and
- Read and accept the Rules by ticking the box “I have read and accepted the rules of the
game”
The Participant may participate as many times as he/she wishes throughout the duration of
the Game, and until the Closing Date, provided that he/she meets the Conditions of Purchase.
Each total purchase for a minimum amount of €150 incl. VAT on the same day in the Centre
gives entitlement to a new participation.
Any participation that does not comply with the Rules, is incomplete or contains incorrect
contact details will be considered null and void.
Any fraud or attempted to defraud the Rules or the Game is prohibited, and the Organiser may
exclude, suspend and/or permanently cancel the participation of one or more Participants in
the event of fraud, attempted fraud or circumvention of the participation rules as laid down in
the Rules. The Organiser reserves the right not to award the Prize and to prosecute the
perpetrators of any fraud before the competent courts.
In any event, the Organiser shall not be liable in any way towards the Participants or any other
person, in the event of fraud or attempted fraud by a Participant.
The Organiser may also cancel all or part of the Game if it appears that fraud has occurred in
any form whatsoever, during the Game.
By accepting the Rules, You confirm and warrant that You are neither a member of the staff of
the Organiser, its subsidiaries and/or the Centre (including the directors, employees, directors,
including those of the stores and restaurants in the Centre), nor a member of their family
(spouse, cohabitee, ascendants and descendants), and that You are not directly or indirectly
involved in the organisation, production, implementation, promotion and operation of the
Game.
Article 4. Designation of the Winner
The prize draw designating the Winner from among all Participants will be conducted by a
court commissioner (commissaire de justice). The draw will take place within 48 hours of the
Closing Date.
An email will be sent by the Organiser to the Winner to the email address they have used to
register with the McArthurGlen Club, within 48 (forty-eight) hours of the draw, to inform them
of their prize and specifying the arrangements for delivery of the Prize.
The Participant must reply to the Organiser's email within 8 (eight) days of the Organiser
sending the email informing him/her that he/she is the Winner, in order to agree with her/her
a date for the official presentation of the Prize (hereinafter "Prizegiving Ceremony"). The
Prizegiving Ceremony must take place within 30 (thirty) days of the Organizer sending the
email to the Winner informing them of their prize.
If the Winner does not reply to the Organiser's email within the aforementioned 8 (eight) days,
the Prize will be lost and the Winner will be deemed to have purely and simply waived the
Prize, which may not under any circumstances be claimed at a later date. A new draw may be
made by the Organiser from among the same Participants by the Commissioner of Justice and
under the same conditions. A new winner will be chosen under the conditions provided for in
this article.
The Organiser may not be held liable for problems inherent in the Internet connection,
electronic communications, the incorrect routing of e-mail or any other technical malfunction
that may occur throughout the duration of the Game.
If the information and email address entered by the Winner are unusable or inaccurate or if
the Winner cannot be identified, it is not the responsibility of the Organiser to carry out
additional searches in order to find the unavailable Winner, who will therefore not receive the
Prize or any compensation or indemnity. The Prize will remain the property of the Organiser,
who may offer it again it at its discretion.
If the Winner expressly waives the right to benefit from his/her Prize, it will be reassigned by
the Organiser without incurring any liability.
Article 5. Prizegiving Ceremony
On the day of the Prizegiving Ceremony, the Winner must go to the Centre's reception desk
(Reception - Guest Services), and present a valid photo identity document, with the Winner
expressly authorising the Organiser to take a copy of the identity document presented.
If the Winner is unable to drive, the Winner must be accompanied by a person holding a French
Category B driving licence, or their international equivalent depending on their country of
residence, to collect the Prize.
The Winner is solely responsible and liable for all taxes, duties, customs duties and, more
generally, all costs incurred by the Winner, including but not limited to transport,
accommodation and subsistence costs, and arising from the collection and use of the Prize.
The Winner will be personally responsible for obtaining the registration certificate for the Prize
and the Organizer will provide the Winner with the car dealer’s contact details so that the
Winner can register the Prize directly with it.
In order to obtain the Prize, the Winner must be in possession of the Prize's registration
certificate on the date of the Prize-giving Ceremony.
The transfer of ownership of the Prize to the Winner is not subject to the law of sale.
Consequently, the Organiser will not be liable for any failures, malfunctions or defects affecting
the Prize.
The Organiser accepts no liability for any incidents or accidents that may occur when using the
Prize.
Article 6. Personal data
Your personal data (surname and first name, contact details, date of birth, country, postal code,
preferred Centre, language) previously collected and/or processed by McArthurGlen UK
Limited for the purposes of registering with the McArthurGlen Club are communicated to MGE
Normandie for the purposes of organising and managing the Game and delivering the Prize.
The legal basis for this processing is the legitimate interest of the Organiser to promote its
company through the Game. Your personal data will be retained for the period necessary for
the organisation of the Game, plus the statutory limitation period for the purpose of
processing any complaint relating to the organisation of the Game. Please note that we rely
on the adequacy decision of the European Commission or the UK to protect Your personal data
when it is transferred between the UK and France.
You may exercise Your rights (i) to access, rectify, erase or restrict the processing of Your
personal data, (ii) to object to the processing of Your Personal Data for reasons relating to Your
particular situation and/or (iii) to define guidelines relating to Your personal data in the event
of death, by contacting McArthurGlen UK Limited by letter containing Your surname and first

You also have the right to lodge a complaint with the French Data Protection Authority (CNIL).

Article 7. Intellectual property rights and copyright
In accordance with the laws governing intellectual property rights and copyright, the use of all
or part of the elements subject to an intellectual property right or protected by the copyright
reproduced in the context of this Game is strictly prohibited, except with the prior written
authorisation of the Organiser.
Article 8. Agreement on evidence
The Participant and the Winner acknowledge and agree that the data, recordings, files and any
other items of the same nature, regardless of the medium, of the Organiser will prevail over
those produced by the Winner or the Participant.
Article 9. Force majeure
In the event of force majeure within the meaning of Article 1218 of the French Civil Code and
the resulting case law, the Organiser may be required to cancel this Competition, shorten it,
extend it, postpone it, suspend it or modify its conditions, and its liability may not be incurred
as a result.
In any event, it reserves the right to extend the participation period referred to in Article 1 of
the Regulations.
Any amendment to the Regulations shall be the subject of an amendment filed with the office
of the Commissioner of Justice referred to in Article 11.
Article 10. Governing Law
The Game is subject to French law. Any dispute relating to the interpretation of the Rules
and/or the organisation of the Game will be submitted to the competent French courts.
Article 11. Consultation of the Rules
The Rules are available in French and English, it being specified that in the event of difficulty
in interpreting the Rules, the French version shall prevail. The Rules are filed with the office of
the Commissioner of Justice of Maître Cédric DELBE, SELARL Cédric DELBE, 6 Rue du Châtel,
27400 Louviers, France.
The Rules can be consulted at the Centre's reception desk (Reception-Guest Services).
