BEFORE ENTERING THE ABOVE PRIZE DRAW, YOU MUST READ AND ACCEPT THESE PRIZE DRAW TERMS AND CONDITIONS. BY PARTICIPATING IN THE ADVENT CALENDAR PROMOTION, YOU ACCEPT THAT YOU ARE BOUND BY THE PRIZE DRAW TERMS AND CONDITIONS.

Prize Draw Terms and Conditions: By participating in the  Countdown to summer Promotion 2025, these Prize Draw Terms and Conditions shall be deemed to be a legally binding agreement between you and the Promoter (as defined below). In particular, by entering the Prize Draw, you agree that the Promoter may use the personal information you provide for activities related to the Prize Draw (including promotional purposes for future Prize Draws, should you be the winner). Participation in the Prize Draw is free of charge and governed solely by these Prize Draw Terms and Conditions.

Promoter: The Promoter of the Prize Draw is Designer Outlet Neumünster (Neumünster Designer Outlet GmbH, Oderstraße 10, 24539 Neumünster; imprint: https://www.mcarthurglen.com/outlets/de/de/designer-outlet-neumuenster/kontakt/). The Prize Draw is in no way sponsored, endorsed or administrated by, or associated with Instagram. Participants indemnify and hold harmless Instagram for any dispute or matter arising out of or in connection with the Prize Draw.

Dates of the Prize Draw: The Prize Draw is taking place between 15 and 30 June 2025. For the duration of the Prize Draw, a new prize shall be announced on the official Instagram account of the Designer Outlet Neumünster (@designeroutletneumunster) daily. To validly participate in the Prize Draw and to be eligible for a specific prize that is part of the Prize Draw, participants must (a) follow the relevant @designeroutletneumunster Instagram account, (b) 'like' (click the 'like button') of the Instagram post regarding that specific prize and (c) place a comment (following the instructions included in that specific post) under the Instagram post. Participants must take all three aforementioned steps within three days after the day of the publication of the Instagram post related to that specific prize. Only one entry per participant per prize is allowed. Multiple entries by the same Instagram account will be disregarded. Participants are not allowed to use more than one Instagram account to participate for the same prize. Participants that take part using multiple Instagram accounts will be disqualified.

Eligibility: Participants in the Prize Draw must be a natural person of legal age and must have an Instagram account. Participants must accept the Instagram platform's terms and conditions to participate in the Prize Draw. Prize draw clubs and automated price draw services are not eligible. The following are also not eligible:

(a) employees or immediate family members of any employee of the Promoter or its promotional partners, their associated companies, agents, affiliates or subsidiaries, and any person otherwise connected with the administration of the Prize Draw.

(b) persons who have already won an (other) Prize Draw organised by the Promoter in the past 24 months.

In addition, the Promoter reserves the right, at its sole discretion, to exclude persons from participation if there are justified reasons, for example (i) in the event of manipulation in connection with access to or the implementation of the Prize Draw, (ii) in the event of breaches of these Terms and Conditions, (iii) in the event of unfair conduct or (iv) in the event of false or misleading information in connection with participation in the Prize Draw.

Age of majority: By participating in the Prize Draw, you confirm that you are 18 years or older.

Prize:  One prize will be drawn per day. The prizes for the Prize Draw vary and can be of different nature, e.g. they can be either items or gift sets of our brand partners or coupons for a dinner in a restaurant of our partners.

Chances of winning: The chances of winning the prizes depend on the number of participants.

Determination of the winners:

(a) Determination of the winners – The winning of the prizes will be determined and awarded strictly at random, one participant will be selected automatically by using a digital comment picker tool. The Promoter will determine in its sole discretion whether participation is in full compliance with these Prize Draw Terms and Conditions.

(b) Notification of Winners – Each of the winners of the prizes determined in the manner described above will be notified via a direct message on Instagram by latest 3rd July 2025 and invited to contact the Centermanagement through the indicated contact details to plan to collect the prize at the Guest Services in the Designer Outlet Center Neumünster, unless otherwise communicated.

(c) Acceptance of the prize - Each winner must confirm acceptance of the prize by receiving the prize until 31st July 2025 at the latest. The prize cannot be paid out in cash or exchanged with other prizes of the Prize Draw or other alternatives. If a winner waives his/her right to the prize, the Promoter is entitled to withdraw the prize for the initial winner and select a replacement winner. If a winner cannot be contacted or does not claim the prize within 14 days after the notification, the Promoter reserves the right to withdraw the prize and either sell it and keep the proceeds, or to give the prize to a third party or charity.

(d) Identification - Each winner must present valid proof of identity (identity card or passport) at the time of prize acceptance.

(e) Promotional purposes - Each participant in the Prize Draw agrees to and consents to the collection, preparation and processing of his/her personal data, images and videos by the Promoter for the purpose of publication on the Promoter’s website and/or for the purpose of marketing, disclosure of names and residences of participants to third parties in connection with the Prize Draw, without receiving any consideration in return; in particular, the Promoter is not obliged to pay any royalties or provide any other consideration. Personal data includes the name, address and date of birth of the participants. Each participant is aware that the data, image and sound recordings are personal data within the meaning of Article 4 number 1 DSGVO and that the use and processing of the data, image and sound recordings by the Promoter are not dependent on any further prior information or additional release in individual cases. Each participant is aware that, in particular, the image and sound recordings can be accessed worldwide when published on the Internet and, if applicable, can be found by search engines, that further use and/or modification by third parties cannot be ruled out and that, under certain circumstances, complete deletion on the Internet is not possible. Each participant may informally revoke his/her consent to the Promoter at any time without stating reasons; the revocation of consent does not retroactively eliminate the lawfulness of the data processing which took place on the basis of the consent given up to the revocation by the Promoter. The processing of the image and sound recordings by the Promoter shall remain lawful until the time of revocation.

Taxes: The Promoter is responsible for reporting and paying all taxes, fees and other charges, insurance premiums and handling charges and any other costs incurred in order to redeem a prize.

Disclaimer: The Promoter makes no warranties or representations of any kind with respect to the Prize Draw, any prize or with respect to (the ability of) any (potential) participant to participate in the Prize Draw, except as expressly set out in these Prize Draw Terms and Conditions. The Promoter excludes all liability for participation in the Prize Draw and is therefore not liable for any damage or other disadvantages resulting from participation in the Prize Draw or from winning or using a prize. This does not apply to damages to life, limb or health or to damages resulting from intentional or grossly negligent injuries of the Promoter, its prize sponsors or its dealers as well as its or their legal representatives or vicarious agents, nor to any liability under the Product Liability Act.

Waiver of any legal rights: By participating in the Prize Draw, you agree to indemnify and hold harmless the Promoter, its prize sponsors, McArthurGlen Designer Outlets retailers and their respective affiliates and employees from and against any and all claims of any nature whatsoever by you, arising directly or indirectly from (a) participation in the Prize Draw (b) receipt, use or misuse of the prize (c) typographical, clerical or other errors in all materials and notices involved, made or given in connection with the Prize Draw (d) other errors in the Prize Draw. This does not apply to damage to life, limb or health or to damage caused by intentional or grossly negligent injuries of the Promoter, its prize sponsors or its dealers or its legal representatives or vicarious agents or to liability under the Product Liability Act.

Trademarks: All trademarks, copyrights and other images displayed are the property of the Promoter or its licensors and are used under written or implied licence. The use of any third-party materials (including such trademarks) does not imply any business relationship between such third parties and the Promoter or vice versa.

Changes: The Promoter reserves the right, at its sole discretion and without prior notice, to suspend, postpone or cancel the Prize Draw or to amend the Prize Draw Terms and Conditions at its sole discretion in the following situations: (a) if a typographical, administrative or other error has occurred, (b) if necessary for the proper and safe conduct of the Prize Draw, (c) if at any time there is evidence of tampering or other unforeseen events that may affect the proper conduct of the Prize Draw. General Provisions: Failure to comply with these Prize Draw Terms and Conditions may (at the sole discretion of the Promoter) result in disqualification from the Prize Draw. This Prize Draw and these Prize Draw Terms and Conditions are governed by German law. The Promoter is under no obligation to disclose any information relating to the Prize Draw, including the number of entry forms received, the number of valid entry forms or any other figures relating to the Prize Draw, except as required by law or as expressly set out in the Prize Draw Terms and Conditions. The Promoter shall not be liable to anyone (including participants) for any delay or failure in the performance of the Prize Draw caused by circumstances beyond the Promoter's control, including (without limitation) internet performance problems, loss or misdelivery of information (including in entry forms), breakdowns or acts of God. The Promoter reserves the right to exclude any individual participant from the Prize Draw if there is reason to believe that the Prize Draw Terms and Conditions have been breached or the Prize Draw has been tampered with by that participant. Disputes relating to the Prize Draw will be decided at the sole discretion of the Promoter, which decision will be final and binding. The right to take legal action is excluded.

Should any provision of these Prize Draw conditions be or become void, invalid or unenforceable in whole or in part, this shall not affect the validity of the remaining provisions of these Prize Draw Terms and Conditions. Instead of the void, invalid or unenforceable provision, the legally permissible provision that comes closest in economic terms to the meaning and purpose expressed in the void, invalid or unenforceable provision shall apply. The same applies in the event of a loophole in these Prize Draw Terms and Conditions.

Personal Data: By participating in the Prize Draw, each participant consents to the processing of their personal data solely in relation to the Prize Draw in accordance with the Promoter's privacy policy. For further information on the processing of personal data and your rights, please refer to the Promoter's privacy policy on its website: https://www.mcarthurglen.com/en/privacy-and-cookies-policy/.

Participation in the Prize Draw requires the provision of personal data. The participant assures that the personal data provided by him/her, in particular first name, surname and email address, are true and correct. The processing of the personal data collected in the context of the Prize Draw is carried out for the implementation and handling of the Prize Draw on the basis of Article 6 para. 1 sentence 1 lit. b GDPR.

The Promoter points out that all personal data of the participant will neither be passed on to third parties nor made available to them for use without consent.

For the purpose of the proper implementation of the Prize Draw the Promoter collects corresponding personal data. The Promoter's data protection declaration (https://www.mcarthurglen.com/en/privacy-and-cookies-policy/) also applies to the handling of this data.
