Terms & Conditions – McArthurGlen Club Prize Draw

Effective February 2024.

This promotion is managed by OPPCI Savills IM European Outlet Fund SAS (Troyes)  with company number 84429047800016, whose registered office is located at 91 boulevard Pasteur 75015 PARIS. Participation in this Sweepstakes implies full acceptance and compliance with the following general conditions (the "General Conditions").

1. To participate in the promotion and, where applicable, claim the prize you must: (a) 18 years of age or older at the time of participation.
   
   2. Claiming the prize implies acceptance of these Terms and Conditions. The prize entitles you to a 100€ gift card, to be collected at Guest Services
   
   All prizes are subject to availability and may be replaced by a similar item of the same value at the Promoter’s discretion.
   
   3. This prize must be claimed by 11th October 2024. Otherwise, the prize will be considered void.

 

4. Only one prize will be awarded to users who are McArthurGlen Club members and scan, almost one time, the QR code at store when they do a purchase. As much as they scan, the users have more possibilities. This prize will be awarded randomly among the participants who meet the participation requirements included in these Terms and Conditions. In addition, the Promoter will officially notify the winning before 1st October by contacting the winner directly through e-mail or any other way.
   
   5. To participate, users must be McArthurGlen Club member and need to scan almost one time, the QR code at store when they do a purchase. As much as they scan, the users have more possibilities. The participation is free, without prejudice to the requirement set forth in this section 5.

   Entries made between 2^nd September and 27 September 2024, will be taken into account, which will start at 09:00 a.m. (CET) and end at 7:00 p.m. (CET).
6. The Promoter reserves the right to request proof of identity and age from any participant.
7. The prize can only be collected in person at the Designer Outlet Troyes Guest Services office. 
8. The prize is not redeemable or transferable and no cash alternative is offered.
9. The Promoter reserves the right to substitute the prize for an alternative of equal or greater value if circumstances beyond the control of the Promoter make it necessary.
10. This promotion is not open to:

• employees of the Promoter or its holding companies or affiliates;
• employees of agents or suppliers of the Promoter or its holding companies or subsidiaries, who are professionally connected with the competition or its administration.
• members of the immediate families or households of (a) and (b) above; and
• people who, due to age or residence, are not eligible to participate in accordance with these General Conditions.

12. Participants consent to participate in advertising related to this promotion in any media, which may include the publication of their name and photograph on the Promoter's social media accounts.
13. The Promoter does not accept any responsibility for the loss, misplacement or damage of the prize once the recipient has picked it up at Designer Outlet Troyes, regardless of the cause. The Promoter accepts no responsibility for purchases that are not completed for any reason.
14. The Promoter reserves the right to withhold, annul, cancel, suspend or modify this promotion when necessary, unilaterally and without prior notice, as well as to eliminate the registration of any participant in the promotion if it detects that it is trying to defraud, alter and/or disable, directly or indirectly, the proper functioning and the normal and regulatory course of the Promotion.
15. The Promoter reserves the right to make modifications to these General Conditions and/or to add successive annexes about its mechanics and its prize, provided that they are justified or do not harm the participants, and are duly communicated during the course of the promotion. 
16. To the extent permitted by law, the Promoter, its agents or distributors shall in no event be responsible for compensating any entrant or accept any liability for any loss, damage, personal injury or death arising as a result of participation in the promotion, except when caused by the negligence of the Promoter, its agents or distributors or that of its employees. Your statutory rights are not affected.

In a non-exhaustive manner, the Promoter will not have any type of responsibility as a consequence of (a) those incomplete entries, received late, lost, invalid, have been manipulated in any way, have been directed to wrong addresses or not They arrive correctly at their destination due to any type of cause such as technical errors, or any other type that may occur when processing the entries; or (b) the temporary lack of availability or continuity of operation of the social networks through which the promotion is organized.

1. 17. The Promoter's decision on any aspect of this promotion is final and binding and no correspondence will be entered into in this regard. In the face of possible doubts in the interpretation of these General Conditions, the Promoter's criteria will always prevail.
   18. Nothing in these conditions excludes the Promoter's liability in the event of fraud or fraudulent misrepresentation.
   19. By participating in this promotion, you agree that any personal information you provide in connection with your participation may be held and used only by the Promoter, as a data controller, or its agents and suppliers to administer this promotion and as set out in these Conditions. The legal bases for the treatment of your data are your consent expressed through your participation in the promotion through Instagram, the execution of the promotion, as well as the fulfillment of the obligations that are applicable, being the treatment of the data strictly necessary for the aforementioned purposes. Participants may exercise the rights provided by the applicable legislation (e.g. access, rectification and deletion, limitation, opposition, withdrawal of consent or data portability), by contacting the Promoter at the address indicated in the General Conditions or through compliance.officer @mcarthurglen.com, clearly indicating the right you wish to exercise. Participants may also submit a claim to the competent control authority.
   20. In case of divergence between the participants and the interpretation of these General Conditions, the Courts and Tribunals of Paris will be competent to hear disputes that may arise, without prejudice to the jurisdiction that may correspond to them in their capacity as consumers and users.
